Legal Basis for Data Processing

  • Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“Regulation”);
  • Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (Infotv.);
  • Act XLVIII of 2008 on Essential Conditions and Certain Limitations of Business Advertising Activity (Advertising Act);
  • Act CVIII of 2001 on Certain Issues of Electronic Commerce Services and Information Society Services.

Definitions (GDPR)

  • “personal data”: any information relating to an identified or identifiable natural person (“data subject”); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person;
  • “processing”: any operation or set of operations which is performed on personal data or on sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction;
  • “restriction of processing”: the marking of stored personal data with the aim of limiting their processing in the future;
  • “controller”: the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data; where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its nomination may be provided for by Union or Member State law;
  • “processor”: a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller;
  • “filing system”: any structured set of personal data which are accessible according to specific criteria, whether centralised, decentralised or dispersed on a functional or geographical basis;
  • “third party”: a natural or legal person, public authority, agency or body other than the data subject, controller, processor and persons who, under the direct authority of the controller or processor, are authorised to process personal data;
  • “consent of the data subject”: any freely given, specific, informed and unambiguous indication of the data subject’s wishes by which he or she, by a statement or by a clear affirmative action, signifies agreement to the processing of personal data relating to him or her.

Information on the Processing of Personal Data

The website https://rohumemories.mnl.gov.hu/ is freely accessible to anyone without providing personal data (registration). During your visit to the website, the MNL system records certain data which MNL uses exclusively for statistical purposes, to optimize our web presence, and to increase system security; this data does not contain personal data.

MNL uses so-called cookies to collect profile data and status data (e.g., IP address, browser type, date and time of entry). Cookies are data that are temporarily transferred from the browser program to your computer’s hard drive when visiting the website, in order to facilitate easier access to the site and simpler retrieval of searched content in the future. You can delete cookies from your computer at any time, or you can disable their use through your browser settings.

In the context of exercising your rights as a data subject, you may at any time request from MNL access to personal data relating to you, rectification or erasure of such data—provided the conditions set out in Articles 16 and 17 of the Regulation are met—or restriction of their processing, and you may object to the processing of such personal data; furthermore, you have the right to data portability as defined in Article 20 of the Regulation.

As a data subject, you are also entitled to lodge a complaint with the supervisory authority if you consider MNL’s data processing to be injurious. During data processing, MNL does not make decisions based on automated processing—including profiling—that would have legal effects concerning you.

MNL ensures the regular processing of personal data by applying appropriate technical means, organizational measures, and internal regulations. MNL proceeds with increased care during the processing and protection of personal data. MNL processes only accurate and, where necessary, up-to-date data, and only for as long as necessary to achieve the purpose of the data processing.

In the case of requests related to data processing, MNL informs the data subject of the measures taken in response to the request within one month of the receipt of the request. If necessary, taking into account the complexity and number of the requests, this deadline may be extended by a further two months in accordance with the rules set out in Article 12 of the Regulation.
